REGULAR SESSION MINUTES
PLANNING AND ZONING COMMISSION
SEPTEMBER 14, 2011

A Regular Session Meeting of the EAST HARTFORD PLANNING AND ZONING COMMISSION was held in the Town Council Chambers, 740 Main Street, East Hartford, Connecticut on September 14, 2011.

The meeting was called to order at 8:24 p.m.

CALL TO ORDER

Chairman Anthony Kayser declared a quorum present. Chairman Kayser stated that Travis Simpson would be voting in place of Kathy Salemi and be acting secretary, and Mary Whaples would be voting in place of Pete Bonzani.  Additionally, Chairman Kayser stated that the Commission would be voting with seven members.

Upon a motion by John Ryan, seconded by Travis Simpson, the Commission Voted (7-0) to Approve the above minutes.  Paul Roczynski did not vote due to his absence from the meeting.

SUBDIVISION APPLICATION OF FRED S. & VICKIE L. FALCONE
Preliminary and Final Layout Approval, Two (2) Lots on 2.17 Acres of land located at
318 Long Hill Street.
Assessor’s Map 61 Lot# 97, 98, 99
Applicant: Fred S. Falcone

Upon a motion by Mary Whaples, seconded by John Grottole, the Commission Voted (7-0) to Approve the above Subdivision Application with the following modifications:

1.      Final plans are to be signed and stamped by the Professional Engineer and/or Land Surveyor licensed in the state of Connecticut who is responsible for the work.
2.      On the subdivision map, add a note specifying all waivers that were granted as part of the subdivision approval.
3.      On the subdivision map, provide two street trees on the proposed lot.
4.      On the subdivision map, revise the proposed grading to direct storm water around the proposed house and provide additional existing contour labels in this area.
5.      On the subdivision map, graphically depict sediment filter fence and a material stockpile area on the proposed lot.
6.      On the subdivision map, graphically depict and specify the limits of pavement repair for the proposed utility laterals.
7.      Subdivision Bond set in the amount of $1,600.00.

Upon a motion by John Ryan, seconded by Mary Whaples, the Commission Voted (7-0) to Approve the following waivers:
•       Section 4.6D(7) – Seepage Test  and Boring Data
•       Section 4.6D(10) –  Valuable Site Resource Mapping
•       Section 5.4J(5)(d) – Monuments
•       Section 5.4K – Conservation Plan
•       Section 5.5H(1) – Electrical & Communications Lines
•       Section 8.9(c) – Sidewalks

automobile and truck sales and services in an existing commercial building on land

Upon a motion by Travis Simpson, seconded by John Ryan, the Commission Voted (7-0) to Approve the above Site Location Approval and reaffirm that this use is associated with a shopping center/mall as defined within the zoning regulations with the following conditions:

1.      Applicant shall obtain a certificate of occupancy prior to signature of the chairman of the Town Planning and Zoning Commission on the state of Connecticut Department of Motor Vehicles K-7 Form.

Upon a motion by Tom Fitzgerald, seconded by John Ryan, the Commission Voted (7-0) to Approve the above Subdivision Application with the following modifications:

1.      Final plans are to signed and sealed by the professional engineer or surveyor licensed in the State of Connecticut that is responsible for the work.
2.      On the subdivision map, provide seepage test and boring data per section 4.6D(7) of the subdivision regulations. (waiver requested)
3.      Within the plan set, provide valuable site resource mapping per section 4.6D(10) of the subdivision regulations. (waiver requested)

Upon a motion by John Grottole, seconded by Paul Roczynski, the Commission Voted (7-0) to Approve the above Bond Release in the amount of $7,000.00.

Upon a motion by Mary Whaples, seconded by Paul Roczynski, the Commission Voted (7-0) to Approve the above 8-24 Referral.

MISCELLANEOUS
•       Staff reviewed with the Commission a potential adult day care use. Staff indicated that the current zoning regulations do not specifically address adult day care. It was recommended by staff that the zoning regulations be amended to possible allow adult day care facilities by special permit in zones which allow convalescent homes by special permit. It was the consensus of the Commission to consider such a text amendment.

•       Staff also discussed the concept of reducing an approved land excavation and fill bond for Rentschler Field with a supplemental legal letter binding the property owner for any amount over the reduced amount. It was the consensus of the Commission to consider such a request as an agenda item at the next regular meeting.
